General Terms and Conditions (GTC)

1. Scope

(1) These General Terms and Conditions (GTC) apply to all orders placed by consumers via the online shop of: YouLabs GmbH Belforter Str. 9

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity (§ 13 BGB).

2. Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding product catalog.

(2) By clicking the "Buy Now" button, you place a binding offer to purchase the goods contained in the shopping cart.

(3) The contract is concluded as soon as we accept your order by sending an order confirmation via email or by shipping the goods.

3. Prices and Shipping Costs

(1) The prices stated at the time of the order shall apply.

(2) All prices include the applicable statutory value-added tax (where applicable).

(3) Shipping conditions and delivery times are set forth in our Shipping Policy.

4. Delivery

(1) Delivery is made to the countries specified in the Shipping Policy.

(2) Delivery times are specified in the respective product offer.

(3) If a product is unavailable, we will inform you immediately.

5. Payment

(1) The payment methods offered in the shop are displayed during the ordering process.

(2) The purchase price is due upon conclusion of the contract.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal. Details can be found in our Cancellation Policy.

8. Exclusion of Withdrawal for Sealed Goods

The right of withdrawal does not apply to contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (§ 312g para. 2 no. 3 BGB).

9. Warranty

Statutory warranty rights shall apply.

10. Liability

(1) We are liable without limitation for intent and gross negligence.

(2) In the event of simple negligence, we are only liable for the breach of an essential contractual obligation (cardinal obligation). In this case, liability is limited to the foreseeable, contract-typical damage.

(3) The limitations of liability do not apply to injury to life, body, or health.

11. Product Information (Dietary Supplements)

(1) Our products are dietary supplements and are not a substitute for a balanced and varied diet and a healthy lifestyle.

(2) The specified recommended daily intake must not be exceeded.

(3) Keep out of reach of small children.

(4) In case of pregnancy, breastfeeding, or existing medical conditions, medical advice should be sought before consumption.

12. Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Applicable Law

(1) The law of the Federal Republic of Germany shall apply to contracts with consumers, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) For consumers residing in Switzerland, this choice of law applies only to the extent that it does not conflict with mandatory provisions of Swiss law.
